esign1. Agreement
These Terms of Service (“Terms”) are an agreement between you and b9design (“we”, “us”, or “our”) for use of b9design.co.za and the products we provide, including web design, application hosting, and cloud management. By creating an account or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility and accounts
You must be able to form a binding contract under applicable law. You are responsible for the accuracy of your account information, keeping your login credentials confidential, and all activity under your account. Notify us promptly at ludwig@b9design.co.za if you suspect unauthorized access.
3. Services
We provide tools to deploy, host, and manage applications, databases, servers, domains, and related resources. Features, plans, and availability may change. We may use infrastructure and orchestration partners to operate the platform. You remain responsible for the software, content, and configuration you deploy.
4. Acceptable use
You may not use the service to:
- Violate law, including copyright, privacy, or export rules.
- Distribute malware, run unauthorized network attacks, or attempt to break into systems.
- Send spam or abusive bulk communications.
- Interfere with other customers or with the security or operation of the platform.
- Resell access except as we expressly permit in writing.
We may suspend or terminate accounts that we reasonably believe violate these Terms.
5. Your content
You retain ownership of code, data, and other content you upload or host (“Customer Content”). You grant us a limited licence to host, copy, and process Customer Content solely to provide the service. You represent that you have the rights needed to use that content on the platform.
6. Billing
Paid plans are billed according to the prices shown at checkout. Payments are processed by our payment provider (Paystack). Fees are generally non-refundable except where required by law or as we agree in writing. Unpaid invoices may lead to suspension or deletion of resources after any applicable grace period.
7. Third-party services
If you connect GitHub, GitLab, Bitbucket, Meta (Facebook), payment providers, or other third-party accounts, their terms also apply. We are not responsible for those services.
8. Availability and support
We aim for reliable uptime but do not guarantee uninterrupted service. Maintenance, outages, and third-party failures may occur. Support is available at ludwig@b9design.co.za.
9. Intellectual property
The b9design name, logos, website, and platform software are owned by us or our licensors. These Terms do not transfer any of that ownership to you.
10. Disclaimer
The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. You are responsible for backups of Customer Content unless a paid feature expressly includes backup as described in your plan.
11. Limitation of liability
To the fullest extent permitted by law, b9design is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service is limited to the amounts you paid us in the three months before the claim.
12. Termination
You may stop using the service and request account deletion as described on our Data deletion page. We may suspend or close an account for breach of these Terms, non-payment, or legal risk. After termination, we may delete Customer Content in line with our Privacy Policy, except records we must retain.
13. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after an update means you accept the revised Terms. If a change is material, we will try to provide reasonable notice.
14. Governing law
These Terms are governed by the laws of the Republic of South Africa. Courts located in South Africa have exclusive jurisdiction, except where consumer law gives you other mandatory rights.
